These Terms and Conditions shall govern the use of services provided by Capricorn Performing Arts (‘we’, ‘us’ or ‘our’), including all classes, programs, workshops, events, and facilities. Any reference to ‘you’ or ‘your’ is to the person making a booking on our website and or engaging in the services provided by us, this will include, students and/or Parent/Guardian of students where applicable. By enrolling in or attending any of our classes or events, you agree to comply with and be bound by these Terms and Conditions. Please read these terms carefully before you make any bookings or use the services provided by us, as they set out important information about your and our rights and obligations.

Enrollment and Registration
Eligibility: We offer classes for all ages and skill levels. Specific age restrictions and skill prerequisites will be required for certain classes, workshops, programs etc and these will be communicated in advance and advertised appropriately.
Registration Process: you must complete an online registration form or in-person registration and provide any requested documentation (e.g., emergency contact information, medical forms).
Confirmation: Enrollment is confirmed after a free trial and once the payment for the first month of membership has been processed.
Uniform: you are required to have a Capricorn Performing Arts T-shirt as part of your uniform if attending a class, workshops, programs etc. This uniform is available on Capricorn Performing Arts official uniform website.
Fees and Payments
Fees: Fees for classes, workshops, and programs are outlined on our website and are subject to change. Any changes in fees will be communicated to you at least within one month in advance.
Payment Methods: There are two options for payment. This can be via our membership or pay as you go on a per class basis. These options and prices are outlined on our website. Payment for classes are due via our membership every month unless otherwise specified. Payment for membership is monthly in advance and payment will be collected on (or around) the date that you began your membership, each month, until cancelled in accordance with these terms and conditions. For pay as you go, payments are due before the beginning of every class. We accept all major credit card and debit card providers. All credit card and debit card payments need to be authorised by the relevant card issuer and we accept cash if paid in person.
Late Payment: If your payment is not received by us when due, we may either charge interest on any balance outstanding at the rate of 8%per year above Bank of England’s base rate from time to time or a one off late payment charge of £5, at our sole discretion. Continued late payment may result in suspension or termination of your membership, and an inability to book classes on a pay as you go basis.
Class Scheduling and Cancellations
Schedule Changes: We reserve the right to change class schedules, instructors, and program content at any time due to unforeseen circumstances. We will notify you of any significant changes.
Cancellations: In the event that we must cancel a class, program, or event, you will be notified promptly, and alternative arrangements will be made which may include rescheduling or a refund in our sole discretion.
Membership Cancellation: Your Membership shall continue until you cancel your membership with us by providing 30 days’ written notice. Your last payment will be a prorated payment depending on when notice has been provided..
No-show/Absences: Fees are non-refundable in the case of absences, including illness or personal reasons.
Your right to cancel: You have 14 days from the date of your booking confirmation email to change your mind and cancel your booking. We will not provide any services during the 14-day cancellation period unless you request for us to do so when you place your booking. We are under no obligation to accept your request. If you request for us to start providing services during the 14-day cancellation period and we agree to do so, this will impact your rights to cancel as follows: a) you lose your right to cancel once the services are fully performed and will not be entitled to a refund even if the cancellation period has not expired; b) if the services have not been fully performed, you will be required to pay for the services we provide up to the time that you told us that you want to cancel. If you cancel within the 14 day cancellation period, we will provide you with a refund as soon as possible and no later than 14 days after the day on which you told us that you want to cancel. If services have been provided during the cancellation period at your request, we will make deductions from any refund due to you as explained in above.
Conduct and Behavior
Conduct: you are expected to conduct yourself respectfully and responsibly while attending classes and events. Disruptive or unsafe behaviour may result in temporary suspension or expulsion. Please see Code of Conduct.
Parent/Guardian Responsibility: Parents or guardians are responsible for the behaviour of their children and ensuring that they comply with the our rules and policies as notified from time to time.
Bullying and Harassment: We maintain a zero-tolerance policy for bullying, harassment, or discrimination. Any instances of such behaviour should be reported immediately to our management.

Health and Safety
Health Requirements: It is your responsibility to disclose any medical conditions or special requirements to us upon registration.We will make reasonable accommodations as needed but are not responsible for providing medical care. We cannot be held reasonable for any loss or damage caused by your failure to keep us informed of any relevant health or medical information. Please ensure that any medications (including epi-pens and inhalers) are brought to each session attended.
Emergency Situations: In the event of an emergency, we will contact the listed emergency contact and, if necessary, seek medical attention.

Media Release and Photography
Media Consent: By enrolling, students and/or student parents/guardians are asked to complete a consent form for us to use and take photographs, video, or audio recordings taken during classes, performances, and events for promotional or educational purposes. We will only ever use photos provided we have your prior consent.You may withdraw consent at any time by written notice to management. If you do so, this does not invalid consent given for any past images.We reserve the right to request no photos or videos be taken by students and/or student parents/guardians in class.
Copyright: Any media created by us (e.g., videos, photos, programs) remains the sole property of us otherwise specified.
Liability and Insurance
Subject to clause 8.3, we accept no liability for any injuries, accidents, or losses incurred by you during participation in any classes, events, or activities.
Subject to clause 8.3, we accept no responsibility for loss or damage of personal belongings or property whilst on the premises.
Nothing in these terms and conditions shall in any way limit our liability for fraud or fraudulent misrepresentation or for death or personal injury caused by its negligence, or any other liability which cannot be excluded at law.
We have Public Liability Insurance and PPL and PRS Music Licences (for further details please contact us directly).
Confidentiality and Data Protection
Personal Data: We will collect and store personal information (e.g., name, contact details, medical information) in accordance with applicable data protection laws. This data will be used solely for the purpose of administering classes, programs, and emergency situations.
Confidentiality: All information shared between students, parents/guardians, will be kept confidential, except where disclosure is required by law.
Privacy Policy: Any health information we hold will be treated sensitively and in line with our Data and Privacy Policy.
Termination and Withdrawal
Termination by you: you may withdraw from any class or program at any time by notifying us in writing. Refunds will be subject to the terms outlined herein.
Termination by us: we reserve the right to terminate your enrollment for reasons including, but not limited to, non-payment, violation of policies, or disruptive behaviour. In such cases, no refund will be issued.
Force Majeure: We will not be liable for any failure to perform our obligations under these terms and conditions if such failure is due to a cause beyond its reasonable control, which includes but is not limited too, natural disasters bad weather (such as heavy snow disrupting transport), pandemic or epidemic, government restrictions, civil unrest, bad weather. In such cases, no refund will be issued.
Governing Law: These Terms and Conditions are governed by the laws of England and any disputes will be subject to the exclusive jurisdiction of the courts of England.
Amendments: We reserve the right to amend or update these terms and conditions at any time. You will be notified of any significant changes, and the updated Terms will be posted on our website.
